Terms of Services

1. Scope of Services
   1. Imgn Creative (“we,” “us,” “our”) is a digital marketing professional team based in Bali, Indonesia, providing services including but not limited to website development, SEO audits, CRM implementation, advertising campaign management, and marketing operations support (“Services”). All Services are delivered on a prepaid, hours-based billing model as described in this Agreement.
2. Engagement Process
   1. Every engagement begins with a Discovery Session, a scoping meeting between Imgn Creative and the Client (“you,” “Client”) to understand the Client’s objectives and requirements.
   2. Following the Discovery Session, Imgn Creative will prepare a Project Plan Estimate, outlining the proposed scope of work, estimated hours, and indicative timeline.
   3. Once the Project Plan Estimate is reviewed and agreed upon by both parties, Imgn Creative will issue a Project Plan Quotation, which sets out all agreed deliverables, associated fees, and payment terms. Work will not commence until the Project Plan Quotation has been accepted in writing by the Client.
3. Fees and Payment
   1. All Services are billed on a prepaid basis. The Client shall make an initial top-up purchase of a minimum of 8 (eight) hours for services such as Website Development or SEO Audit before work begins.
   2. Where the Client requires additional or recurring services beyond the initial engagement including but not limited to Website Support or CRM Implementation — the Client may purchase additional hours through a “Top-Up” request. Top-Up purchases do not include Ads Management services, which are billed and scoped separately.
   3. Hours are deducted from the Client’s prepaid balance as work is performed. Imgn Creative will notify the Client when the prepaid balance is low, so the Client may purchase additional hours to avoid interruption of Services.
4. Reporting and Client Statements
   1. Imgn Creative will provide the Client with a Client Statement on a periodic basis, detailing the work performed, hours consumed, and remaining prepaid balance, to ensure transparency in how purchased hours are used.
5. Data Protection and Privacy
   1. Imgn Creative processes personal data in accordance with applicable data protection law, including, where relevant, Regulation (EU) 2016/679 (General Data Protection Regulation, “GDPR”) for Clients or data subjects within the European Union or European Economic Area, and Law No. 27 of 2022 on Personal Data Protection (“UU PDP”) of the Republic of Indonesia.
   2. Imgn Creative will only collect and process personal data that is necessary to perform the Services, and will implement reasonable technical and organizational measures to protect such data against unauthorized access, loss, or misuse.
   3. Data subjects have the right to access, correct, or request deletion of their personal data, and to object to certain processing activities, in accordance with GDPR and/or UU PDP as applicable. Requests may be directed to hello@imgn-creative.com.
   4. Where personal data is transferred outside of Indonesia or the European Economic Area, Imgn Creative will take reasonable steps to ensure such transfers comply with applicable cross-border data transfer requirements.
   5. In the event of a personal data breach, Imgn Creative will notify affected Clients and, where legally required, the relevant supervisory authority, without undue delay and in accordance with the notification timelines prescribed by applicable law.
